Please read these terms carefully before purchasing a package, booking a class or using any FOCUS service.

GENERAL TERMS

AGREEMENT TO THESE TERMS

These Terms of Service (“Terms”) form a legally binding agreement between you and Focus Boutique Fitness Limited (“FOCUS”, “we”, “us” or “our”).

These Terms apply to your access to and use of focuscycle.com.hk, our official mobile applications, booking platforms, social media booking functions, studios, classes, events, facilities, equipment and related services (collectively, the “Services”).

By purchasing any package, creating an account, making a booking, entering our premises or participating in a class, you confirm that you have read, understood and agreed to these Terms and any package-specific conditions displayed at the time of purchase.

If you do not agree to these Terms, you must not purchase, book, attend or continue using the Services.

AGE REQUIREMENT

You must be at least 18 years old to enter into this Agreement. Members under 18 may only use the Services with the consent of a parent or legal guardian and subject to any minimum-age or safety requirements imposed by FOCUS.

ACCOUNT INFORMATION

You must provide complete, accurate and current information when creating or using an account. You are responsible for all bookings, purchases and activities carried out through your account and for keeping your login credentials secure.

Accounts may not be sold, assigned, lent or used by another person unless expressly permitted under an eligible shareable package.

ALL PACKAGES

PACKAGE TERMS & CONDITIONS

ALL SALES ARE FINAL

Except where otherwise required by applicable law, all packages, memberships, credits, trial offers, promotional offers and gift vouchers are final and strictly non-refundable, non-exchangeable and non-convertible into cash.

Members should assess their schedule, health, travel plans and ability to attend before purchasing. Members who require greater flexibility should purchase a smaller package.

PACKAGE ACTIVATION

Unless otherwise expressly stated, package validity begins on the date of the member’s first attended class and not on the purchase date.

A package that has not been activated within 60 days from its purchase date may automatically expire without refund, extension or compensation, unless a different activation period is stated at the time of purchase.

PACKAGE EXPIRY

Every package has a fixed validity period. All unused credits automatically expire at the end of that validity period.

Expired or unused credits will not be refunded, exchanged, reinstated, transferred or extended unless FOCUS expressly approves otherwise in writing or applicable law requires otherwise.

NON-TRANSFERABLE PACKAGES

Unless a package is expressly identified as “Shareable”, it may only be used by the registered purchaser and may not be transferred, shared, resold or used to make bookings for another person.

SHAREABLE PACKAGES

Shareable packages may only be used by the purchaser and approved registered users linked to the package in accordance with our current sharing procedures.

FOCUS may impose a maximum number of approved users, require identity verification and reject or remove a sharing user where misuse, resale, unauthorised commercial activity or account abuse is suspected.

The purchaser remains responsible for all bookings, cancellations, charges and conduct arising from use of the shareable package. Sharing access does not extend the package validity period.

TRIAL PACKAGES

Trial packages are intended for first-time customers and are limited to one trial purchase per person, unless otherwise expressly stated or approved by FOCUS.

FOCUS may cancel duplicate or ineligible trial purchases and may require identity, telephone number, email address, payment-method or account verification.

PRICES AND PACKAGE CONDITIONS

Prices, package benefits, validity periods, promotions, schedules and availability may change from time to time. Changes will not retrospectively alter a completed purchase unless required by law.

The package terms displayed and accepted at the time of purchase will normally apply to that transaction. Where a clear technical, typographical, pricing or system error has occurred, FOCUS may cancel or correct the affected transaction and return the amount actually paid.

NO RESALE OR COMMERCIAL USE

Packages, credits, bookings and promotional benefits may not be resold, advertised for resale or used for unauthorised commercial purposes. Any affected package or account may be suspended or terminated without compensation, subject to applicable law.

RHYTHM CYCLING TERMS

BIKE RESERVATIONS

Bike selection is subject to availability and operational requirements. FOCUS does not guarantee any particular bike, position, instructor, class format or studio configuration.

For safety and fairness, reserved bikes may be released to another member if the booked member is not physically present and checked in at least five minutes before the scheduled class start time.

LATE ARRIVALS

Members arriving after the class has started may be refused entry for safety and class-quality reasons. The booking will be treated as a late cancellation or no-show and the relevant credit will be forfeited.

CYCLING SAFETY

Members must follow all instructor instructions concerning bike setup, resistance, footwear, posture, movement and emergency procedures.

Always bring the pedals and flywheel to a complete stop before dismounting. Members must notify the instructor before class if they are new, pregnant, recovering from illness or injury, or require assistance with bike setup.

MINIMUM ATTENDANCE

FOCUS may cancel or combine a Rhythm Cycling class if the minimum attendance requirement is not met. Where reasonably practicable, affected members will be notified before class and the booking credit will be returned to their account. No further compensation will be payable.

REFORMER @ THE ONE

REFORMER PILATES TERMS

ADVANCE RESERVATION

All Reformer Pilates classes require advance booking through an official FOCUS booking channel. A reservation is only confirmed when it appears as confirmed in the member’s booking account.

REFORMER ALLOCATION

Reformer allocation, instructor assignment, class format and studio arrangement are subject to availability, safety and operational requirements. FOCUS does not guarantee a particular reformer, position or instructor.

LATE ARRIVALS

Pilates classes include essential setup and safety instructions at the beginning of class. A member arriving after class has started may be refused entry without refund, replacement credit or extension.

GRIP SOCKS

Suitable grip socks must be worn during Reformer Pilates classes. A member without appropriate grip socks may be required to purchase or obtain a suitable pair before participating. Entry may be refused where the instructor considers participation unsafe.

PREGNANCY, INJURY AND MEDICAL CONDITIONS

Members who are pregnant, recovering from surgery or injury, or experiencing a medical condition must obtain appropriate medical advice before participating and notify the instructor before class.

FOCUS may request medical clearance and may refuse or restrict participation where reasonably considered necessary for safety.

EQUIPMENT CARE

Members must use reformers, springs, straps, boxes, bars and all other equipment only as instructed. A member may be responsible for the reasonable repair or replacement cost of damage caused deliberately or through negligent misuse.

MINIMUM ATTENDANCE

FOCUS may cancel, combine or reschedule a Reformer Pilates class where the minimum attendance requirement is not met or where cancellation is reasonably required for operational or safety reasons.

The affected booking credit will be returned to the member’s account. No additional refund, compensation or package extension will be provided.

PRIVATE PILATES

Private and semi-private Pilates sessions may be subject to separate booking, payment, cancellation and instructor availability requirements displayed at the time of booking.

CLASS MANAGEMENT

BOOKINGS, CANCELLATIONS & NO-SHOWS

CANCELLATION WINDOW

Unless a different cancellation period is stated for a specific class or service, class bookings must be cancelled through an official booking channel no later than five hours before the scheduled class start time.

Cancellation requests sent through social media, personal instructor accounts or unofficial channels may not be accepted.

LATE CANCELLATION AND NO-SHOW

A cancellation made after the applicable cancellation deadline, failure to attend, refusal of entry due to lateness, or failure to comply with a mandatory safety requirement will result in forfeiture of the credit used for the booking.

Where an unlimited package or membership is used, FOCUS may impose the applicable late-cancellation or no-show charge displayed in the package terms or booking platform.

MEDICAL WAIVER REQUESTS

A member seeking discretionary consideration due to sudden illness must contact FOCUS through its official customer service channel and provide a valid medical certificate within 24 hours after the scheduled class.

Medical waiver requests are reviewed individually and are not automatically approved. Repeated, incomplete, late or unverifiable requests may be rejected.

WAITLIST BOOKINGS

A waitlist booking becomes a confirmed booking once a place is automatically allocated. Members are responsible for checking their booking status, notifications and cancellation deadlines.

CLASS CHANGES AND CANCELLATIONS

FOCUS may substitute instructors, adjust schedules, change class formats, relocate classes, allocate different equipment, combine classes or cancel classes due to instructor illness, insufficient attendance, equipment failure, safety concerns, maintenance, system errors or operational requirements.

Where FOCUS cancels a class, the credit used for that class will normally be returned to the member’s account. Instructor, equipment or timetable changes alone do not entitle a member to a refund, compensation or package extension.

EARLY DEPARTURE

Members intending to leave before the end of class should notify the instructor beforehand. Re-entry after leaving a class may be refused.

PACKAGE MANAGEMENT

FREEZE & EXTENSION REQUESTS

MEDICAL FREEZE

Members who are injured, pregnant or recovering from surgery may submit a package-freeze request with a valid doctor’s letter stating the relevant period during which exercise is not recommended.

APPLICATION REQUIREMENTS

Freeze requests must normally be submitted at least seven days before the requested freeze start date. Retroactive freezes will not normally be granted.

The minimum approved freeze period is two weeks. Unless FOCUS agrees otherwise, the maximum total freeze period will not exceed 50% of the package’s original validity period.

An administration fee of HK$500 per approved freeze request may apply and must be paid before the freeze becomes effective.

Non-medical freeze or extension requests are considered at FOCUS’s discretion and may be rejected. Submission of a request does not guarantee approval.

MEMBER RESPONSIBILITY

HEALTH, FITNESS & CONDUCT

PERSONAL FITNESS DECLARATION

By participating, you confirm that you are physically and medically capable of taking part in the selected activity or have obtained appropriate professional medical advice.

You must not exercise beyond your own capabilities. You must immediately stop and notify the instructor if you experience pain, dizziness, faintness, breathing difficulty or any other concerning symptom.

INSTRUCTOR DIRECTIONS

Members must comply with all reasonable safety instructions, studio rules, warning signs and equipment procedures. Instructors may modify or stop a member’s participation where reasonably considered necessary for safety.

MEMBER CONDUCT

Abusive, threatening, discriminatory, disruptive, unsafe or inappropriate conduct toward staff, instructors, contractors or other members is prohibited.

FOCUS may refuse entry, remove a person from the premises, suspend bookings or terminate an account where reasonably necessary to protect safety, staff, members, property or normal business operations.

PERSONAL BELONGINGS

Personal belongings are brought to the premises at the member’s own risk. To the maximum extent permitted by law, FOCUS is not responsible for loss, theft or damage except where caused by its negligence or where liability cannot lawfully be excluded.

RISK & RESPONSIBILITY

ASSUMPTION OF RISK & LIABILITY

Exercise, including indoor cycling and Reformer Pilates, involves inherent risks. These may include muscular strain, falls, impact injuries, dizziness, fainting, abnormal blood pressure and other adverse physical events.

By voluntarily participating, you acknowledge and accept the ordinary and inherent risks associated with the activity and agree to exercise responsibly and within your capabilities.

Nothing in these Terms excludes or restricts any liability that cannot lawfully be excluded or restricted.

Subject to the preceding paragraph and to the maximum extent permitted by law, FOCUS will not be liable for indirect, incidental, special or consequential loss, loss of profit, business interruption, reputational loss or loss of data arising from use of the Services.

THIRD-PARTY SERVICES

Booking platforms, payment providers, websites, applications and other third-party services may be subject to their own terms and technical availability. FOCUS is not responsible for a third party’s independent acts, omissions or service interruptions, except to the extent required by law.

FORCE MAJEURE

FOCUS will not be responsible for delay, closure, interruption, cancellation or inability to provide Services caused by circumstances beyond its reasonable control, including severe weather, fire, flood, epidemic, pandemic, government restrictions, civil disturbance, utility failure, building closure or other force majeure event.

DIGITAL & STUDIO CONTENT

INTELLECTUAL PROPERTY & MEDIA

INTELLECTUAL PROPERTY

The Site, applications, class concepts, branding, logos, photographs, videos, music selections, written materials, graphics and other content owned by or licensed to FOCUS are protected by applicable intellectual-property laws.

They may not be copied, recorded, reproduced, distributed, sold, adapted or commercially exploited without prior written permission.

FILMING AND PHOTOGRAPHY

Photography or filming may occasionally take place at our studios, classes or events for operational, community, promotional or marketing purposes.

Members who do not wish to be included should inform staff before the relevant class or activity begins. FOCUS will take reasonable steps to accommodate such requests.

Members may not record instructors or other members without their consent or where recording would interfere with safety, privacy or the class experience.

PERSONAL DATA

Personal data will be handled in accordance with our Privacy Policy and applicable Hong Kong data-protection requirements.
